("Promotion")

Eligibility: Promotion is open only to legal residents of the 50 United States and District of Columbia that are 18 years of age or older. The Promotion is void where prohibited. All federal, state, and local laws and regulations apply. Martha White Foods Inc. ("Sponsor"), and its parent, subsidiaries, affiliated companies, advertising and promotion agencies, webmasters/suppliers, and their respective employees, officers, and directors, and their respective immediate family members (spouse, parents, siblings, children) or household members (whether or not related) are ineligible. By entering you agree to these Official Rules.
To Enter: Between November 9, 2008 12:00 AM ET and January 18, 2009 11:59 PM ET, access the website at www.marthawhite.com, click on the Promotion banner or link to access the Promotion page, and then follow the directions to choose your favorite Martha White® recipes and enter. Four recipe categories with four different Martha White recipes, as selected by Sponsor, will be available to choose your favorite Martha White® recipe for every meal. All entries must be received and recorded by Sponsor's computer (the official Promotion time keeping device) by 11:59 PM ET each day of the Promotion. When online, you will need to enter your full name, address, city, state, zip code, daytime phone number, e-mail address, date of birth; choose your favorite recipes for each meal from the recipes provided; agree to these Official Rules; and click "Submit Entry." Limit one entry per person or e-mail address per day (12:00 AM ET to the following 11:59 PM ET). No robotic, programmed, script, macro or other automated entries (collectively "automated entries"). Automated entries, or, multiple entries in a day by the same person/email address, or entries that have been tampered with will result in disqualification of all such entries. All entry information submitted becomes the property of Sponsor and will not be returned.
Prize Details/Odds: 70 Daily Prizes One winner daily, starting November 9, 2008 for 70 consecutive days, will be awarded: One $20 Smucker's® Online Store Gift Certificate.10 Weekly Prizes One winner weekly, starting November 16, 2008 for ten consecutive Sundays, will be awarded: One programmable slow cooker. ARV of each Weekly Prize is $50. One First Prize One winner will be awarded: One grocery store gift card valued at $1,000, a triple buffet server, and a programmable slow cooker. ARV of First Prize is $1,229. One Grand Prize One winner will be awarded: One grocery store gift card valued at $1200, a Lodge Enamel Cookware Set, a triple buffet server and a programmable slow cooker. ARV of Grand Prize is $1,869. Total ARV of all prizes is $4,998. Sponsor reserves the right to replace any prize with another of similar value. Prize is non-transferable and no substitutions or cash redemptions will be made. If a winner cannot accept the prize as stated, the prize will be forfeited and awarded to an alternate winner if circumstances permit. Odds of winning depend on the number of eligible entries received.
Drawing: One Daily Winner will be selected via random drawing each day following voting (November 10, 2008 through January 19, 2009) from each day's eligible votes. Each Daily Winner will be announced on the website at the beginning of the following day and all Daily Winners will be contacted via e-mail. Each Daily Prize will be e-mailed to each Daily Winner during the promotional period. One Weekly Prize Winner will be selected via random drawing each Sunday following voting (November 16, 2008 through January 18, 2009) from each weekfs eligible votes. Each Weekly Winner will be announced on the website at the beginning of the following week and all Weekly Winners will be contacted via e-mail. Each Weekly Prize will be mailed to each Weekly Winner at the end of the Promotion on or about January 30, 2009. One First Prize Winner and one Grand Prize Winner will be selected on or about January 20, 2009 from all eligible votes. The First Prize and Grand Prize will be mailed at the end of the Promotion on or about February 28, 2009. Limit one Daily and one Weekly Prize per person, family, household, or e-mail for the entire Promotion. The drawing and awarding of each prize will be conducted by Sponsor, whose decisions are final and binding in all matters relating to the Promotion. If a winner is a minor in his/her jurisdiction of residence, the prize may be awarded in the name of, or to, winner's parent/legal guardian who must execute all documents and agree to all obligations and undertakings of winner, both on behalf of himself/herself and winner, or prize may be forfeited and awarded to an alternate winner. If due to any technical, production or other error, more prizes are claimed or awarded than are described in these Official Rules at any prize level, the number of prizes identified in these Official Rules will be awarded in a random drawing from all such prize claims received. No more than the number of prizes stated in these Official Rules will be awarded.
General Conditions: By entering, entrants agree (a) that Sponsor and its parent, affiliates, subsidiaries, advertising and promotion agencies, and all of their officers, directors, employees, representatives and agents, are indemnified, released and will be held harmless by entrants from any and all liability, for any damages, injuries or losses of any kind to person(s), including death, or property, arising directly or indirectly from the acceptance, possession, misuse or use of a prize or his/her participation in the Promotion or any Promotion-related activity; and (b) winner grants (and agrees to confirm such grant in writing promptly upon request) to Sponsor and those acting under Sponsorfs authority the right to the use of his/her name, photograph, likeness, voice, image, statements and biographical information at any time or times for advertising, trade, publicity and promotional purposes in any media now known or hereafter discovered, worldwide and on the World Wide Web, without review, notification, approval or additional compensation, unless prohibited by law. Winner (or parent or legal guardian if winner is a minor) will be required to complete, sign and return an Affidavit of Eligibility and Liability Release and, where lawful, Publicity Release within seven days of receipt of notification. If documents are not returned in a timely manner, or if any prize notification or prize is returned as non-deliverable, or if winner is found to be ineligible or otherwise not in compliance with these Official Rules, the prize will be forfeited and an alternate winner selected if circumstances permit. All taxes on the prize, if any, are solely the responsibility of the winner. By entering, entrants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrantfs rights and obligations, or the rights and obligations of the Sponsor in connection with the Promotion, will be governed by, and construed in accordance with, the laws of the State of Ohio, without giving effect to any choice of law or conflict of law rules. By entering, entrants consent to the jurisdiction and venue of the federal, state and local courts in Cleveland, OH. The information you disclose when you register for the Promotion will be subject to the Privacy Policy set forth on the above website.
Limitations of Liability In the event of a dispute regarding the identity of an entrant, such entry will be deemed to be made by the authorized account holder of the e-mail address submitted at the time of entry. gAuthorized account holderh is deemed as the natural person who is assigned to an e-mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e mail addresses for the domain associated with the submitted e-mail address. Neither Sponsor nor its agencies are responsible for lost, late, stolen, illegible, misdirected, or non-delivered entries, or e-mail; or for lost, interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), website or other connections availability, accessibility or traffic congestion, or miscommunications, or failed computer, network, telephone, satellite, or cable hardware, software or lines, or technical failure, or jumbled, scrambled, delayed, or misdirected transmissions, or computer hardware or software malfunctions, failures or difficulties, or other errors of any kind whether human, mechanical, electronic or network, or the incorrect or inaccurate capture of entry or other information or the failure to capture, or loss of, any such information. Neither Sponsor nor its agencies are responsible for any incorrect or inaccurate information, whether caused by website users, or by any equipment or programming associated with or utilized in the Promotion and assume no responsibility for any error, omission, interruption, deletion, defect or delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or tampering with or hacking of website. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds may be tampering with the entry process or operation of the Promotion or website, may be acting in violation of the terms of the website or may be acting in a non-sportsmanlike or disruptive manner, or with intent to threaten, abuse or harass any other person. Neither Sponsor nor its agencies are responsible for injury or damage to entrantfs or any other personfs computer related to or resulting from entering in the Promotion or downloading or copying materials from or use of website. If, for any reason, the Promotion is not capable of running as planned by reason of infection by computer virus, worms, bugs, tampering, hacking, unauthorized intervention, fraud, technical failures or any other causes which, in sole opinion of the Sponsor, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Promotion, and determine winner from entries received prior to action taken, or as otherwise deemed fair and equitable by Sponsor. Any attempt to deliberately damage any website or undermine the legitimate operation of the Promotion is unlawful and subject to legal action by Sponsor or its agents.
IN NO EVENT WILL SPONSOR, ITS AFFILIATES, SUBSIDIARIES OR RELATED COMPANIES, THEIR ADVERTISING OR PROMOTION AGENCIES OR THEIR OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES OR AGENTS BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF ENTRANTS ACCESS TO AND USE OF THE PROMOTION INTERNET SITE OR DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SAID SITE.
